Cleared in Case After Case, Yet Still Behind Bars: Imran Khan’s Bail Paradox

Pakistan’s former Prime Minister Imran Khan has now spent over three years in Adiala Jail, and a striking pattern has emerged around his legal battles: case after case against him has ended in acquittal or bail, yet he remains locked up. His supporters argue this shows the cases were never really about the law — and each time one door closes, another opens to keep him inside.

 

 

 

A Long List of Cleared Cases

Khan has faced more than 150 criminal cases since his ouster from power in 2022. Over time, courts have cleared him in a large share of them:

  • He was acquitted in the original Toshakhana case and the Iddat (marriage) case in 2023.
  • Courts granted him bail in all cases linked to the May 9, 2023 riots, including attacks on military installations — with judges specifically noting there was “no justification” to keep him arrested once his co-accused were already free on bail.
  • He has also secured bail or acquittal pleas in numerous other cases tied to alleged incitement and unlawful assembly.
  • In February 2026, a sessions court even extended his pre-arrest bail in five more cases, including one involving an alleged attempted murder charge.

Each time, PTI has celebrated the news as a “victory” — and each time, government officials have quickly clarified that Khan would not walk free, because other convictions kept him behind bars.

 

 

 

 

The Convictions That Remain

The reason Khan hasn’t been released, despite this string of legal relief, comes down to two major convictions that are still active:

  1. Al-Qadir Trust case (January 2025): Khan was sentenced to 14 years and his wife, Bushra Bibi, to 7 years over an alleged £190 million ($245 million) corruption scheme involving land and repatriated UK funds. He has appealed, but the Islamabad High Court has repeatedly delayed hearing the sentence-suspension plea — pushing it from March, to March 31, to June, and further, citing procedural objections from the National Accountability Bureau and jurisdictional disputes over which court can even hear the appeal.
  2. Toshakhana-2 case (December 2025): Khan and his wife were each handed 17-year sentences over a Bulgari jewellery set allegedly gifted by the Saudi Crown Prince during Khan’s time as prime minister.

So while dozens of individual cases have fallen away, these two convictions are what keep him in Adiala Jail. PTI and human rights advocates argue this is exactly the pattern they’ve raised concerns about: as older cases collapse, new charges or slow-moving appeals take their place, ensuring Khan never actually walks free.

 

 

 

 

PTI’s Argument: A Moving Target

PTI leaders have repeatedly made the same point publicly — that once Khan clears one case, the goalposts shift to the next. A party spokesperson said as far back as late 2024 that Khan had “either been acquitted from or…been granted bail” in virtually every case brought against him, yet somehow there was still “no reason for him to be in prison” — and still no release. Government officials, for their part, have consistently responded that release is “not possible” as long as any conviction or pending case remains active, framing it as a legal rather than political reality.

The appeal process itself has drawn criticism for its pace. The IHC’s own chief justice has at times expressed frustration with delays, at one point fining the accountability bureau for what the court called “delaying tactics.” Even so, the core Al-Qadir Trust appeal — Khan’s clearest remaining path to potential release — has been bounced between the high court and Supreme Court over technical questions of jurisdiction for months, with no final resolution in sight as of August 2026.

 

 

 

 

The Bigger Picture

Rights groups, including submissions referencing the UN Working Group on Arbitrary Detention, have described this repeated pattern — bail or acquittal in one case followed by continued detention on another — as part of a broader campaign against Khan. The government rejects this characterization, maintaining that Khan remains a convicted individual serving sentences handed down by courts, and that due process, however slow, is being followed.

For now, the practical result is unchanged: despite winning relief in the majority of cases filed against him since 2022, Imran Khan remains in Adiala Jail, with his most significant legal battles — and his path to freedom — still tied up in appeals that have yet to reach a conclusion.
